Welcome to Fable Forge ("we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, and our AI-powered interactive storytelling platform (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms and acknowledge that you have read and understood our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service.
Fable Forge provides a fictional, interactive storytelling experience powered by artificial intelligence. You acknowledge that the Service is currently in a beta phase and is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be uninterrupted, secure, or free from errors. Features may be added, modified, or removed at any time without notice. The Service is designed to produce Safe For Work (SFW) content, and we employ content filters and other safeguards. However, due to the probabilistic nature of artificial intelligence, the Service may occasionally generate responses that are inaccurate, unexpected, offensive, or inappropriate. You use the Service at your own risk.
You are solely responsible for all activity that occurs under your account.
Our Intellectual Property: The Service itself, including the website, underlying software, our proprietary characters, worlds, and all associated branding and logos, are the exclusive property of Fable Forge and its licensors.
Your Content: You retain ownership of the original creative input you provide to the Service in the form of prompts ("User Content"). However, by using the Service, you grant Fable Forge a worldwide, non-exclusive, royalty-free license to use, process, reproduce, and modify your User Content solely for the purpose of operating, providing, and improving the Service for you.
AI-Generated Output: In consideration of your compliance with these Terms, we grant you a limited, non-exclusive, personal, revocable license to use the AI-generated text and stories produced by the Service for you ("AI Output") for your personal, non-commercial entertainment purposes. You may not reproduce, distribute, or create derivative works from the AI Output for commercial purposes without our express written permission. This license is contingent upon your continued compliance with these Terms.
The Service may offer virtual credits for purchase. All purchases are processed through secure third-party payment processors. All sales are final, and credits are non-refundable. This policy does not exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law (ACL) that cannot be lawfully excluded. We are not responsible for credits lost due to an account suspension or termination resulting from a violation of these Terms.
We may suspend or terminate your access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. You may terminate your account at any time by following the instructions within the Service or by contacting us. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FABLE FORGE DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FABLE FORGE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition, right, or remedy implied or imposed by any statute (including the Australian Consumer Law) which cannot lawfully be excluded or limited.
We reserve the right to modify these Terms at any time. If we make changes, we will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of New South Wales to resolve any legal matter arising from these Terms.
